Privacy Policy

1) Introduction and Contact Details of the Controller

1.1 We are pleased that you are visiting our website and thank you for your interest. In the following, we will inform you about the handling of your personal data when you use our website. Personal data refers to all data with which you can be personally identified.

1.2 The controller for data processing on this website, in the sense of the General Data Protection Regulation (GDPR), is Corinne Samson & Joanna Kapitza GbR, Dachauer Str. 114, 80636 Munich, Germany, Tel.: +49 174 1755995 / +49 178 6129396, E-mail: hello@anotherbrand.de. The controller responsible for the processing of personal data is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.

2) Data Collection When Visiting Our Website

2.1 When using our website for informational purposes only, i.e., if you do not register or otherwise provide us with information, we only collect data that your browser transmits to our server (so-called "server log files"). When you access our website, we collect the following data, which are technically necessary for us to display the website to you:

  • Our visited website
  • Date and time of access
  • Amount of data sent in bytes
  • Source/reference from which you accessed the page
  • Browser used
  • Operating system used
  • IP address used (if applicable: in anonymized form)

Processing is carried out in accordance with Art. 6 Para. 1 lit. f GDPR based on our legitimate interest in improving the stability and functionality of our website. There will be no disclosure or other use of the data. However, we reserve the right to retrospectively check the server log files if concrete indications of unlawful use arise.

2.2 This website uses SSL or TLS encryption for security reasons and to protect the transmission of personal data and other confidential content (e.g., orders or inquiries to us). You can recognize an encrypted connection by the string "https://" and the lock symbol in your browser line.

3) Hosting & Content Delivery Network

For the hosting of our website and the display of page content, we use a provider who performs their services, either themselves or through selected subcontractors, exclusively on servers within the European Union.

All data collected on our website are processed on these servers.

We have concluded a data processing agreement with the provider, which ensures the protection of our site visitors' data and prohibits unauthorized disclosure to third parties.

4) Cookies

To make visiting our website attractive and to enable the use of certain functions, we use cookies, which are small text files stored on your device. Some of these cookies are automatically deleted after closing the browser (so-called "session cookies"), while others remain on your device for a longer period, enabling the storage of page settings (so-called "persistent cookies"). In the latter case, you can find the storage duration in the overview of your web browser's cookie settings.

If individual cookies used by us also process personal data, the processing is carried out in accordance with Art. 6 Para. 1 lit. b GDPR either for the execution of the contract, in accordance with Art. 6 Para. 1 lit. a GDPR in the event of given consent, or in accordance with Art. 6 Para. 1 lit. f GDPR to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the site visit.

You can set your browser so that you are informed about the setting of cookies and can decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or in general.

Please note that if cookies are not accepted, the functionality of our website may be limited.

5) Contacting Us

When you contact us (e.g., via contact form or email), personal data will be processed exclusively for the purpose of processing and responding to your inquiry and only to the extent necessary for this purpose.

The legal basis for the processing of this data is our legitimate interest in responding to your inquiry in accordance with Art. 6 Para. 1 lit. f GDPR. If your contact aims at concluding a contract, the additional legal basis for processing is Art. 6 Para. 1 lit. b GDPR. Your data will be deleted when it can be inferred from the circumstances that the matter concerned has been conclusively clarified and provided that no statutory retention obligations conflict with this.

6) Use of Customer Data for Direct Marketing

6.1 Newsletter Subscription

If you subscribe to our email newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your email address. The provision of further data is voluntary and will be used to address you personally. For sending the newsletter, we use the so-called double opt-in procedure, which ensures that you will only receive the newsletter if you have explicitly confirmed your consent to receive newsletters by clicking on a verification link sent to the provided email address.

By activating the confirmation link, you give us your consent for the use of your personal data in accordance with Art. 6 Para. 1 lit. a GDPR. In this context, we store your IP address registered by the Internet Service Provider (ISP), as well as the date and time of registration, to be able to trace a possible misuse of your email address at a later date. The data collected by us during newsletter registration will be used strictly for the intended purpose.

You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by sending a corresponding message to the controller mentioned at the beginning. After unsubscribing, your email address will be immediately deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to further data use that is legally permitted and about which we inform you in this statement.

6.2 Sending of Email Newsletter to Existing Customers

If you have provided us with your email address when purchasing goods or services, we reserve the right to regularly send you offers for similar goods or services, like those already purchased, from our product range via email. For this, we do not need to obtain separate consent from you according to § 7 Para. 3 UWG. Data processing in this respect is solely based on our legitimate interest in personalized direct marketing in accordance with Art. 6 Para. 1 lit. f GDPR. If you have initially objected to the use of your email address for this purpose, we will not send you any emails.

You are entitled to object to the use of your email address for the aforementioned advertising purpose at any time with effect for the future by sending a message to the controller mentioned at the beginning. For this, you will only incur transmission costs according to the basic rates. Upon receipt of your objection, the use of your email address for advertising purposes will be stopped immediately.

6.3 Brevo

Our email newsletters and other promotional email communications are sent via this provider: Brevo GmbH, Köpenicker Str. 126, 10179 Berlin, Germany.

Based on our legitimate interest in effective and user-friendly email marketing, we transfer the data provided during your registration in accordance with Art. 6 Para. 1 lit. f GDPR to this provider, so that they can handle the email dispatch on our behalf.

We reserve the right, exclusively based on your express consent in accordance with Art. 6 Para. 1 lit. a GDPR, to additionally perform a statistical success evaluation of email campaigns using web beacons or tracking pixels in the sent emails, which can measure opening rates and specific interactions with the newsletter's content. Device information (e.g., time of access, IP address, browser type, and operating system) is also collected and evaluated but not merged with other data sets.

You can revoke your consent for email tracking at any time with effect for the future.

We have concluded a data processing agreement with the provider, which protects the data of our site visitors and prohibits disclosure to third parties.

7) Data Processing for Order Fulfillment

7.1 Insofar as necessary for contract fulfillment for delivery and payment purposes, the personal data collected by us will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 Para. 1 lit. b GDPR.

If we owe you updates for goods with digital elements or for digital products based on a corresponding contract, we process the contact data you provided during the order (name, address, email address) to inform you personally about upcoming updates within the legally prescribed period in accordance with our legal information obligations pursuant to Art. 6 Para. 1 lit. c GDPR via a suitable communication channel (e.g., by postal mail or email). Your contact data will be used strictly for the purpose of communicating about updates owed by us and processed by us only to the extent necessary for the respective information.

To process your order, we also work with the following service provider(s), who support us wholly or partially in the execution of concluded contracts. Certain personal data are transmitted to these service providers in accordance with the following information.

7.2 Disclosure of Personal Data to Shipping Service Providers

– DHL

As a transport service provider, we use the following provider: DHL Paket GmbH, Sträßchensweg 10, 53113 Bonn, Germany

We pass on your email address and/or telephone number to the provider in accordance with Art. 6 Para. 1 lit. a GDPR before the delivery of the goods for the purpose of coordinating a delivery date or for delivery notification, provided that you have given your express consent for this in the ordering process. Otherwise, for the purpose of delivery, we only pass on the recipient's name and delivery address to the provider in accordance with Art. 6 Para. 1 lit. b GDPR. The disclosure only takes place insofar as it is necessary for the delivery of the goods. In this case, a prior coordination of the delivery date with the provider or the delivery notification is not possible.

Consent can be revoked at any time with effect for the future towards the controller designated above or towards the provider.

7.3 Use of Payment Service Providers (Payment Services)

– PayPal

This website offers one or more online payment methods from the following provider: PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg

If you choose a payment method from the provider that requires you to pay in advance, your payment data communicated during the ordering process (including name, address, bank and payment card information, currency, and transaction number) as well as information about the content of your order will be passed on to them in accordance with Art. 6 Para. 1 lit. b GDPR. The transfer of your data in this case is exclusively for the purpose of payment processing with the provider and only to the extent necessary for this.

If you choose a payment method where we pay in advance, you will also be asked to provide certain personal data (first and last name, street, house number, postal code, city, date of birth, email address, telephone number, possibly data for an alternative payment method) during the ordering process.

To protect our legitimate interest in determining your creditworthiness in such cases, this data is forwarded by us to the provider for a credit check in accordance with Art. 6 Para. 1 lit. f GDPR. Based on the personal data you provide and other data (such as shopping cart, invoice amount, order history, payment experiences), the provider checks whether the payment option you have selected can be granted with regard to payment and/or default risks.

The credit report may contain probability values (so-called score values). Insofar as score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. Address data, among other things, but not exclusively, are included in the calculation of the score values.

You can object to this processing of your data at any time by sending a message to us or to the provider. However, the provider may still be entitled to process your personal data if this is necessary for contractual payment processing.
– PayPal Checkout

This website uses PayPal Checkout, an online payment system by PayPal, which consists of PayPal's own payment methods and local third-party payment methods.

When paying via PayPal, credit card via PayPal, direct debit via PayPal, or – if offered – "Pay Later" via PayPal, we transfer your payment data during the payment process to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal"). The transfer takes place in accordance with Art. 6 Para. 1 lit. b GDPR and only to the extent necessary for payment processing.

PayPal reserves the right to conduct a credit check for credit card payments via PayPal, direct debit via PayPal, or – if offered – "Pay Later" via PayPal. For this purpose, your payment data may be transferred to credit agencies in accordance with Art. 6 Para. 1 lit. f GDPR based on PayPal's legitimate interest in determining your creditworthiness. PayPal uses the result of the credit check regarding the statistical probability of payment default to decide on the provision of the respective payment method. The credit report may contain probability values (so-called score values). Insofar as score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. Address data, among other things, but not exclusively, are included in the calculation of the score values. You can object to this processing of your data at any time by sending a message to PayPal. However, PayPal may still be entitled to process your personal data if this is necessary for contractual payment processing.

If available and selected, for the PayPal payment method "Invoice Purchase," your payment data will first be transmitted to PayPal for payment preparation, whereupon PayPal will forward it to Ratepay GmbH, Franklinstraße 28-29, 10587 Berlin ("Ratepay") for payment execution. The legal basis in each case is Art. 6 Para. 1 lit. b GDPR. In this case, RatePay performs an identity and credit check in its own name to determine creditworthiness, following the principle already mentioned above, and transfers your payment data to credit agencies based on its legitimate interest in determining creditworthiness in accordance with Art. 6 Para. 1 lit. f GDPR. A list of credit agencies that Ratepay can use can be found here: https://www.ratepay.com/legal-payment-creditagencies/

When using a local third-party payment method, your payment data will first be transferred to PayPal for payment preparation in accordance with Art. 6 Para. 1 lit. b GDPR. Depending on your selection of an available local payment method, PayPal will then transmit your payment data to the corresponding provider for payment execution in accordance with Art. 6 Para. 1 lit. b GDPR:

  • Apple Pay (Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland)
  • Google Pay (Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland)

7.4 Electronic Right of Withdrawal Function for Distance Contracts

Consumers who conclude contracts on this website where a statutory right of withdrawal exists have the option to declare the withdrawal via an electronic withdrawal function in accordance with the applicable withdrawal provisions.

When using the withdrawal function, in addition to information for identifying the contract to be withdrawn, further personal information such as the first and last name and the email address of the consumer must be provided or confirmed.

The collection of this information and its transmission to us takes place in accordance with Art. 6 para. 1 lit. b GDPR and only insofar as it is necessary for the proper processing of the revocation. Also based on Art. 6 para. 1 lit. b GDPR, the provided personal data will be used to confirm receipt of the revocation declaration by email. Another legal basis for the processing is Art. 6 para. 1 lit. c GDPR. We are legally obliged to maintain an electronic revocation function for fee-based consumer distance contracts.

8) Web Analysis Services

Google (Universal) Analytics

This website uses Google (Universal) Analytics, a web analysis service of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”), which allows an analysis of your use of our website.

By default, when you visit the website, Google (Universal) Analytics sets cookies, which are stored as small text modules on your device and collect certain information. The scope of this information also includes your IP address, which Google, however, truncates by the last digits to exclude direct personal identifiability.

The information is transmitted to Google servers and further processed there. This may also include transfers to Google LLC, based in the USA.

Google uses the collected information on our behalf to evaluate your use of the website, to compile reports on website activities for us, and to provide other services associated with website and internet usage. The truncated IP address transmitted by your browser within the scope of Google Analytics is not merged with other Google data. The data collected within the scope of using Google (Universal) Analytics is stored for a period of two months and then deleted.

All processing described above, in particular the setting of cookies on the device used, only takes place if you have given us your explicit consent in accordance with Art. 6 para. 1 lit. a GDPR. Without your consent, Google (Universal) Analytics will not be used during your visit to the site. You can revoke your given consent at any time with effect for the future. To exercise your right of revocation, please deactivate this service via the "Cookie Consent Tool" provided on the website.

We have concluded an order processing agreement with Google, which ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

Further legal information on Google (Universal) Analytics can be found at https://business.safety.google/intl/de/privacy/, https://policies.google.com/privacy?hl=de&gl=de and at https://policies.google.com/technologies/partner-sites

Demographic characteristics
Google (Universal) Analytics uses the special function "demographic characteristics" and can thereby create statistics that provide information about the age, gender, and interests of site visitors. This is done by analyzing advertising and information from third parties. This allows target groups for marketing activities to be identified. However, the collected data cannot be assigned to a specific person and will be deleted after being stored for a period of two months.

Google Signals
As an extension to Google (Universal) Analytics, Google Signals can be used on this website to create cross-device reports. If you have activated personalized ads and linked your devices to your Google account, Google may, subject to your consent to the use of Google Analytics in accordance with Art. 6 para. 1 lit. a GDPR, analyze your usage behavior across devices and create database models, including cross-device conversions. We do not receive personal data from Google, but only statistics. If you want to stop cross-device analysis, you can disable the "Personalized advertising" function in your Google account settings. Follow the instructions on this page: https://support.google.com/My-Ad-Center-Help/answer/12155764?hl=de. Further information on Google Signals can be found at the following link: https://support.google.com/analytics/answer/7532985?hl=de.

UserIDs
As an extension to Google (Universal) Analytics, the "UserIDs" function can be used on this website. If you have consented to the use of Google (Universal) Analytics in accordance with Art. 6 para. 1 lit. a GDPR, have set up an account on this website and log in to this account on different devices, your activities, including conversions, can be analyzed across devices.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with the European data protection level based on an adequacy decision by the European Commission.

9) Retargeting/Remarketing and Conversion Tracking

Meta Pixel with Advanced Matching

Within our online offering, we use the "Meta Pixel" service from the following provider in advanced matching mode: Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland ("Meta").

If you click on an advertisement placed by us on Facebook or Instagram, the URL of our linked page will be extended by a parameter with the help of "Meta Pixel". This URL parameter is then entered into your browser after redirection by a cookie that our linked page itself sets. In addition, this cookie collects specific customer data such as your e-mail address, which we collect on our website linked to the Facebook or Instagram ad during processes such as purchases, account logins, or registrations (advanced matching). The cookie is then read and enables the transmission of the data, including your specific customer data, to Meta.

We use "Meta Pixel" with advanced matching to make our advertisements (so-called "Ads") on Facebook and/or Instagram more effective and to ensure that they match your interests or have certain characteristics (e.g., interests in certain topics or products identified based on the websites visited) that we transmit to Meta (so-called "Custom Audiences").

Furthermore, we analyze the effectiveness of our advertisements by tracking whether users were redirected to our website after clicking on an advertisement (conversion). Compared to the standard version of "Meta Pixel", the advanced matching function helps us to better measure the effectiveness of our advertising campaigns by capturing more attributed conversions.

All transmitted data is stored and processed by Meta, so that an assignment to the respective user profile is possible and Meta can use the data for its own advertising purposes in accordance with Meta's Data Use Policy (https://www.facebook.com/about/privacy/). The data may enable Meta and its partners to display advertisements on and off Facebook.

All processing described above, in particular the setting of cookies for reading information on the terminal device used, will only be carried out if you have given us your explicit consent in accordance with Art. 6 para. 1 lit. a GDPR. You can revoke your given consent at any time with effect for the future by deactivating this service in the "Cookie Consent Tool" provided on the website.

We have concluded an order processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

The information generated by Meta is usually transferred to a Meta server and stored there; in this context, a transfer to servers of Meta Platforms Inc. in the USA may also occur.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with the European data protection level based on an adequacy decision by the European Commission.

10) Tools and Other

10.1 Cookie Consent Tool

This website uses a so-called "Cookie Consent Tool" to obtain effective user consent for cookies and cookie-based applications requiring consent. The "Cookie Consent Tool" is displayed to you in the form of an interactive user interface when you visit the page, where you can grant consent for certain cookies and/or cookie-based applications by checking boxes. In doing so, all cookies/services requiring consent are only loaded through the use of the tool if you grant corresponding consent by checking boxes. This ensures that such cookies are only placed on your respective device if consent has been given.

The tool sets technically necessary cookies to store your cookie preferences. Personal user data is generally not processed here.

If, in individual cases, personal data (such as the IP address) is processed for the purpose of storing, assigning, or logging cookie settings, this is done in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in legally compliant, user-specific, and user-friendly consent management for cookies and thus in a legally compliant design of our website.

Another legal basis for the processing is also Art. 6 para. 1 lit. c GDPR. As controllers, we are subject to the legal obligation to make the use of technically non-essential cookies dependent on the respective user's consent.

Where necessary, we have concluded an order processing agreement with the provider, which ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

Further information about the operator and the setting options of the Cookie Consent Tool can be found directly in the corresponding user interface on our website.

10.2 Doofinder

This website uses the search technology service of the following provider: DooFinder S.L., Madrid 28037, Rufino González 23 bis, 1º 1, Spain

For the provision of the search function for articles via the search field and for navigation and filters, the provider collects and stores certain user information (e.g., user or session ID) in an anonymized form.

If personal data is also processed in this context, the processing takes place in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in providing a fault-tolerant search for articles and thus in an optimal marketing of our offer.

11) Rights of the Data Subject

11.1 The applicable data protection law grants you, as the data subject, the following rights (rights to information and intervention) with regard to the processing of your personal data by us as the controller, with reference to the legal basis cited for the respective exercise conditions:

  • Right to information according to Art. 15 GDPR;
  • Right to rectification according to Art. 16 GDPR;
  • Right to erasure according to Art. 17 GDPR;
  • Right to restriction of processing according to Art. 18 GDPR;
  • Right to notification according to Art. 19 GDPR;
  • Right to data portability according to Art. 20 GDPR;
  • Right to withdraw given consents according to Art. 7 para. 3 GDPR;
  • Right to lodge a complaint according to Art. 77 GDPR.

11.2 RIGHT TO OBJECT

IF WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST WITHIN THE FRAMEWORK OF A BALANCING OF INTERESTS, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, WITH EFFECT FOR THE FUTURE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE THE PROCESSING OF THE DATA CONCERNED. HOWEVER, FURTHER PROCESSING REMAINS RESERVED IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR IF THE PROCESSING SERVES THE ASSERTION, EXERCISE, OR DEFENCE OF LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING. YOU CAN EXERCISE THE OBJECTION AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE THE PROCESSING OF THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

12) Duration of Storage of Personal Data

The duration of the storage of personal data is determined by the respective legal basis, the purpose of processing and – if applicable – additionally by the respective statutory retention period (e.g. commercial and tax law retention periods).

When processing personal data based on explicit consent according to Art. 6 para. 1 lit. a GDPR, the data concerned will be stored until you revoke your consent.

If there are statutory retention periods for data processed within the framework of legal or quasi-legal obligations based on Art. 6 para. 1 lit. b GDPR, this data will be routinely deleted after the expiry of the retention periods, provided that it is no longer necessary for contract fulfillment or initiation and/or we no longer have a legitimate interest in further storage.

When processing personal data based on Art. 6 para. 1 lit. f GDPR, this data will be stored until you exercise your right to object according to Art. 21 para. 1 GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.

When processing personal data for direct marketing purposes based on Art. 6 para. 1 lit. f GDPR, this data will be stored until you exercise your right to object according to Art. 21 para. 2 GDPR.

Unless otherwise stated in the other information in this declaration regarding specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
